La Terza Sezione penale della Corte di cassazione ha affermato che in base alla nuova disposizione di cui all’art. 578-bis cod. proc. pen., ed alla luce della pronuncia della Grande Camera della Corte EDU del 28 giugno 2018, G.I.E.M. S.r.l. contro Italia, il proscioglimento per intervenuta prescrizione, maturato nel corso del processo, non osta alla confisca del bene oggetto di lottizzazione abusiva, a condizione che la relativa decisione abbia accertato l’esistenza del reato e la colpevolezza dell’imputato attuando tutte le garanzie proprie delle pronunce formali di condanna, attesa la natura “sostanzialmente penale” della sanzione irrogata, ai sensi dell’art. 4 del Protocollo n. 7 della Convenzione EDU.
